Any Prospective Adoptive Parents (PAP) living abroad will be considered as Inter Country Adoption.
A Non Resident Indian (NRI) could be where PAP is on work permit or where at least one parent is holding an Indian passport. A Foreign Adoption is where the PAP is foreign and citizen of a country abroad.
BSSK has a large waiting list of domestic families hence less children are available for NRI or Foreign applicants. Therefore, BSSK has restricted to NRI’s all over the world and Foreign Adoption only in the countries of U.S.A and Norway.
The Central Adoption Resource Authority (CARA) has issued Guidelines for Adoption from India 2006. PAP can visit CARA website www.adoptionindia.nic.in.
Families in U.S.A. can directly enquire with Holt International Children Services, the website address is www.holtintl.org
Families in Norway can directly enquire with Verdens Barn, Children of the World, the website address is www.verdensbarn.no
- Ages of couples.
- Marital years and stability.
- Health status – mental and physical fitness.
- Financial securities – stable income, sufficient savings, investments, Policies etc.
- Police Clearances.
- Motivation to adopt and expectations will be assessed.
Inter Country Adoption process can be routed through a licensed Social Service Organization in the country of residence of Prospective Adoptive Parents (PAP). Further it should be enlisted with Central Adoption Resource Authority (CARA) New Delhi, India. The Enlisted Foreign Agency list is updated on CARA’s website ‘ www.adoptionindia.nic.in’
Other than this any Government Department/Ministry or any authorized body of the foreign country can process the intercountry adoption. It is expected to mutually accept the requirements of the adopters and adoptee's respective country.
In case of an Indian national residing abroad where there are no such enlisted agency / department in that country then CARA may allow an organization or individual (qualified social worker) recommended by the Indian Embassy to do the Adoption/Home Study Report, undertaking as prescribed in CARA guidelines. Also the Indian Embassy needs to give their approval letter.
The list of documents that need to be followed from the respective country will be shared with PAP upon receiving the Application Form. All documents needs to be notarized, the signature of the notary either to be attested by the Indian Embassy / High Commission or the appropriate Govt. Department of the receiving country.
When a PAP is a NRI, (at least one parent holds Indian passport), then a child can be assigned without going through Adoption Coordinating Agency (ACA), Pune.
If a PAP who is holding foreign passports or is a Foreigner, then we need to make additional efforts for domestic placements through ACA before the child is considered free for Inter- Country Adoption.
When we receive the complete adoption dossier along with the child assignment papers countersigned by the family, then within a few days the dossier is sent to CARA via courier. CARA takes a couple of weeks to process their say. Only when we receive the CARA No Objection Certificate (NOC) can the case be filed in the respective court.
For Hindu Adoption cases (adoptive father needs to be a Hindu),
- PAP can personally file the adoption petition in the District Court, Pune
- Can take child in pre-adoptive foster care.
- During this period a Post Placement Report through a recognized agency needs to be submitted to court.
- Also the Indian Council of Social Welfare (ICSW) scrutiny body for the court gives its say.
- A final hearing date is scheduled.
- Depending on the judges the hearing can come up only after 4 to 6 weeks from the date of filing petition in court.
- The adopting parent/s with their child need to be present in the court in Pune for the final hearing.
- Either the PAP or Power Attorney holder can file the adoption petition in Family Court, Pune.
- Only for NRI’s can a child be placed under preadoptive foster care, if the family wishes to travel to India before legalization.
- In this period a Post Placement Report through a recognized agency needs to be submitted to court.
- Also the Indian Council of Social Welfare (ICSW) scrutiny body for the court gives its say to the court.
- A final hearing date is scheduled.
- Depending on the judges the hearing can come up only after 4 to 6 weeks from the date of filing petition in court.
After the case is heard in District and Family Court then the judge dictates the order. To complete the court order formalities and to receive the certified court order in hand takes further 2 weeks. Then we can apply for the passport of the child.
The above processing period from receiving the complete dossier (including child assignment papers) to receiving the child’s passport in hand can vary from 3 to 4 months. This period can vary, as we have to work with different agencies/officials/judges at CARA, ICSW, Courts and Passport office.
Post Legal follow-up report (CARA format) has to be sent to CARA, ICSW, COURTS and the Placement agency through the enlisted agency.
